Our goal is to maintain your trust and confidence when handling personal information about you. This Privacy Policy describes how we may use, collect, retain and share information, including personal information. This Privacy Policy applies to your use of all websites, applications, products, and services provided, owned, or operated by AlcaCruz, Inc. and its Subsidiaries and Affiliates including without limitation, CruzTV, (hereinafter all AlcaCruz entities are collectively referred to as “AlcaCruz”) that link to this Privacy Policy (collectively, “AlcaCruz Services”). For purposes of data protection laws, AlcaCruz, Inc., located at 411 Borel Ave., Suite 510, San Mateo CA 94402, is the “data controller” of your information.

You may share personal information when using the AlcaCruz Services. One example is when you provide information about yourself as part of CruzTV account registration process. Another is when you take certain actions that are public or intended to be public in nature, such as when you post profile information, broadcast content, participate in a chat room, or follow or subscribe to a channel. Given the social nature of some of the AlcaCruz Services, that information may be collected, used, or disclosed by others. In addition, some features of the AlcaCruz Services are designed to provide others with information about user activity, such as identifying the user who created a particular clip.
By agreeing to this Privacy Policy in your account set up for AlcaCruz Services or by using AlcaCruz Services, you consent to the extent permitted by law to the information handling practices described in this Policy.
Personal Information AlcaCruz Collects About You
We obtain information about you through the means discussed below when we provide the AlcaCruz Services. Please note that we need certain types of information so that we can provide the AlcaCruz Services to you. If you do not provide us with such information, or ask us to delete it, you may no longer be able to access or use the AlcaCruz Services.

User-provided Information: When you register for AlcaCruz Services, or download, upload, purchase, or view certain content or products from the AlcaCruz Services, or otherwise use AlcaCruz Services, you may provide personal information about yourself to us, such as your name, email address, mailing address, telephone number, credit card number, and/or billing information.

Automatically Collected Information: When you access the AlcaCruz Services or open one of our emails, we automatically record and store certain information about your system by using cookies and other types of technologies. Cookies are small text files containing a string of alphanumeric characters that are sent to your browser. Examples of such information we automatically collect may include Internet Protocol address (“IP Address”), unique user ID, device and browser types and identifiers, referring and exit page addresses, software and system type, and information about your usage of AlcaCruz Services. Examples of how AlcaCruz uses automatically collected information include: (a) automatically updating the AlcaCruz application on your system; (b) remembering your information so that you will not have to re-enter it during your visit or the next time you access the AlcaCruz Services; (c) providing customized ads, content, and information; (d) monitoring the effectiveness of marketing campaigns; (e) monitoring and storing aggregate site usage metrics such as total number of visitors and pages accessed; and (f) tracking your entries, submissions, and status in tournaments, contests, promotions, or other activities.

Information from Other Sources: We may obtain additional information such as demographic and statistical information from third parties and sources other than the AlcaCruz Services, such as advertisers or social media networks (for example, Facebook, Twitter) for which you have approved our access. When you access the AlcaCruz Services through social media networks or when you connect the AlcaCruz Services to social media networks, you are authorizing AlcaCruz to collect, store, and use such additional information and content in accordance with this Privacy Policy. We may also obtain information from third-party services (such as Steam or video game publishers) regarding your use of such services, including about your use of the content you choose to broadcast through the AlcaCruz Services. We use this information to provide better experiences for you with the AlcaCruz Services and improve AlcaCruz Services, analytics, and advertising. If we combine or associate information from other sources with information that we collect through the AlcaCruz Services, we will treat the combined information in accordance with this Privacy Policy.

How AlcaCruz Uses Personal Information

AlcaCruz uses such information to operate, maintain, enhance, provide, create, and develop AlcaCruz Services. We also use it to provide security for our websites, products, software, or applications; manage relationships with AlcaCruz partners and affiliates, including making or receiving payments; provide content recommendations and advertising to augment and improve your experience with the AlcaCruz Services; allow you to comment on content, and participate in online games, contests, or rewards programs; prevent fraud and abuse; and understand the usage trends of our users.

We use your email address to communicate with you, including to notify you of major AlcaCruz Services updates, for customer service purposes, or to contact you regarding any content that you have posted to or downloaded from the AlcaCruz Services.

AlcaCruz may send promotional materials or notifications to you related to AlcaCruz Services. If you want to stop receiving promotional materials, you can go to your account settings once you have logged in to the AlcaCruz Services or follow the unsubscribe instructions at the bottom of any email from us. If you have installed a mobile app and you wish to stop receiving push notifications, you can change the settings either on your mobile device or through the app.

We may also ask for your consent to process your personal information for a specific purpose that we communicate to you. When you consent to our processing your personal information for a specific purpose, you may withdraw your consent at any time, and we will stop processing of your data for that purpose.

AlcaCruz may rely on legal grounds to process your personal information to the extent permitted by applicable law, which may include, without limitation: to fulfill legal or contractual obligations, to take steps in anticipation of entering into contract, your consent, and AlcaCruz’s legitimate interests.

When AlcaCruz Discloses Personal Information

We disclose such information to service providers working on our behalf. For example, we may disclose information for: website hosting, maintenance, and security services, fulfill orders, conduct data analysis and create reports, offer certain functionality, or help us improve AlcaCruz Services and create new services and features. You may decline to share certain information with AlcaCruz, in which case AlcaCruz may not be able to provide to you some of the features and functionality found on the AlcaCruz Services. If you have created an AlcaCruz Services or CruzTV account, depending on the service, you may be able to update your profile information and preferences or disable your account by logging in and going to the settings page. For other requests to review, update, delete, or otherwise limit AlcaCruz’s use of information that you have provided directly to AlcaCruz, you may contact privacy@alcacruz.com. In your request, please include your email address, name, address, and telephone number and specify all relevant background. To protect your privacy and security, we may take steps to verify your identity before granting you access or making corrections to your information. You are responsible for maintaining the secrecy of your unique password and account information at all times.

The AlcaCruz Services may link to third-party websites or services. The privacy practices of those third parties are not governed by this Privacy Policy. We encourage you to review the privacy policies of these third-party websites and services to understand their practices. If you connect to a third-party service (such as Facebook, SnapChat, Twitter, or another third-party application) through the AlcaCruz Services or otherwise link your AlcaCruz account with a third-party service, you are requesting and authorizing us to share or grant access to information on your behalf (such as your username, the fact that your connection originated from the AlcaCruz Services, and other relevant usage and diagnostic information) with such third party. We may also send information about the content you watch or your activities on the AlcaCruz Services to such third parties. For example, we may make information available to game publishers or app developers to facilitate purchases and awards of digital goods, such as games and in-game items.

Advertisers and Analytics Providers
We may use third-party Web analytics services in connection with the AlcaCruz Services, such as those of Google Analytics, and its advertising features. These service providers use a variety of tracking technologies such as cookies to analyze how users use the AlcaCruz Services. The information collected (described above in “Automatically Collected Information”) will be collected directly by these service providers to evaluate your use of the AlcaCruz Services. AlcaCruz does not provide information that is intended to identify you personally to these third-party ad servers or ad networks without your consent. However, if you respond to an ad that targets a certain audience (for example, males age 18 to 30 who have participated in certain promotions), the advertiser or ad-server may conclude that you fit the description of the audience that they were trying to reach.

Do Not Track
Do Not Track (“DNT”) is a privacy preference that users can set in certain web browsers. DNT is a way for users to inform websites and services that they do not want certain information about their webpage visits collected over time and across websites or online services. AlcaCruz does not recognize or respond to browser-initiated DNT signals. However, we provide the Network Advertising Initiative, the Digital Advertising Alliance, and Your Online Choices opt-out links above to enable you to opt-out as you choose regarding information collected on our website for third-party purposes.

Retention of Your Information
We keep your personal information to enable your continued use of AlcaCruz Services, for as long as it is required in order to fulfill the relevant purposes described in this Privacy Policy, as may be required (or permitted) by law such as for tax and accounting purposes, or as otherwise communicated to you.

Account Closure & Deletion
If you would like to close your account and delete your profile information on the CruzTV app or other AlcaCruz Services, please contact us at privacy@alcacruz.com. If you close your account, AlcaCruz may retain certain information about you for the activities described in this Privacy Policy, or as permitted or required by applicable law.

Children’s Privacy
IF YOU ARE UNDER 13 YEARS OF AGE, THEN PLEASE DO NOT USE OR ACCESS THE ALCACRUZ SERVICES AT ANY TIME OR IN ANY MANNER.

Protecting the privacy of children is especially important. For that reason, AlcaCruz does not knowingly collect or maintain personal information (as defined by the United States Children’s Online Privacy Protection Act) from persons under 13 years-of-age. If AlcaCruz learns that personal information of persons under 13 has been collected on or through the AlcaCruz Services, AlcaCruz will take appropriate steps to delete this information.

If you are the parent or legal guardian of a child under 13 who has become an AlcaCruz Services member, then please contact AlcaCruz at privacy@alcacruz.com to have that child’s account terminated and personal information deleted.
For residents of the EEA, where processing of personal information is based on consent, AlcaCruz will not knowingly engage in that processing for users under the age of consent established by applicable data protection law. If we learn that we are engaged in processing with such users, we will halt such processing and will take reasonable measures to promptly remove applicable information from our records.
